Practitioner Terms & Conditions Agreement
Root to Blossom Herbal Dispensary
(For Licensed Acupuncturists & Certified Herbalists in Washington State.
1. Purpose
This Agreement establishes the terms under which Root to Blossom Herbal Dispensary (“Dispensary”) provides Chinese herbal products and compounding/dispensing services to licensed acupuncturists and certified herbalists (“Practitioner”) in the State of Washington.
2. Eligibility & Licensure
- Practitioner affirms they are licensed in Washington State as an East Asian Medicine Practitioner (EAMP) under RCW 18.06 or otherwise hold a valid herbal certification recognized by the Dispensary.
- Practitioner is solely responsible for maintaining an active license, registration, and any continuing education required by the Washington State Department of Health (DOH).
- Practitioner shall discontinue the use of the Dispensary immediately if their license or certification lapses, is suspended, or revoked.
3. Scope of Services
- The Dispensary prepares and dispenses raw herbs, granules, and finished herbal formulas as requested by Practitioner for use with their clients/patients.
- Products are provided for professional use only and are not sold directly to the general public, except when dispensed pursuant to a Practitioner’s order.
- Practitioner is responsible for patient assessment, formula selection, dosage, and clinical monitoring.
4. Product Standards & Compliance
- The Dispensary sources herbs from suppliers that meet recognized quality, safety, and purity standards (e.g. tested for heavy metals, pesticides, and contaminants).
- Practitioner acknowledges that herbal products are regulated as dietary supplements in the U.S. and are not FDA-approved drugs.
- The Dispensary provides labeling with ingredient lists and dosage instructions as supplied by the Practitioner. Practitioner is responsible for ensuring clinical appropriateness.
5. Practitioner Responsibilities
- Use Products only within the legal and professional scope of East Asian medicine practice.
- Provide accurate and complete information when submitting formula requests.
- Ensure patients are informed of the nature of herbal therapies, potential risks, and contraindications.
- Maintain their own patient records in compliance with Washington State DOH requirements.
6. Payment & Pricing
- Practitioner agrees to pay for any Products and services in the event that their client does not pay for their order.
- Prices are subject to change with reasonable notice.
- Client Payment is due at time of pick up or mailing, unless otherwise agreed.
7. Returns & Liability
- Custom compounded formulas are non-returnable.
- Any Product issues need to be reported within 5 business days.
- Dispensary’s liability is limited to replacement or refund of defective Products.
- Practitioner assumes responsibility for all clinical use of Products dispensed under their direction.
8. Indemnification
Practitioner agrees to indemnify and hold harmless the Dispensary, its owners, and staff against any claims, damages, or liabilities arising from the Practitioner’s use of Products or services, including but not limited to patient claims, regulatory actions, or malpractice.
9. Insurance
Practitioner shall maintain professional liability (malpractice) insurance covering their herbal practice. Proof of insurance may be requested.
10. Confidentiality
Both parties agree to comply with HIPAA and applicable privacy laws regarding patient information. The Dispensary will maintain confidentiality of any patient data shared for formula fulfillment.
11. Term & Termination
- This Agreement begins on the Effective Date below and continues until terminated by either party.
- The Dispensary may suspend or terminate immediately for non-payment, breach of this Agreement, or loss of Practitioner licensure/certification.
12. Governing Law & Dispute Resolution
- This Agreement shall be governed by and construed under the laws of the State of Washington.
- Disputes will first be submitted to mediation in King County, WA. If unresolved, disputes shall be handled in the courts of Washington State.
13. Entire Agreement
This document constitutes the entire agreement between Practitioner and Dispensary regarding use of Dispensary services and supersedes all prior agreements.
